Introduction
1.1. In this privacy policy, “Lizard DAO”, “us”, “we” or “our” means the Lizard decentralised autonomous organisation (DAO). We recognise the importance of protecting the privacy of Lizard DAO Activities (as defined in the Terms and Conditions). The following privacy policy (Privacy Policy) is the way we handle information gathered about you from your use and interactions with Lizard DAO Activities.
1.2. PLEASE REVIEW THIS PRIVACY POLICY CAREFULLY. When you submit information to or through the use of Lizard DAO Activities, you consent to the collection and processing of your information as described in this Privacy Policy. By partaking in the Lizard DAO Activities, you accept the terms of this Privacy Policy and the Terms and Conditions, confirm that you are at least eighteen (18) years old, or the legal age of capacity in your local jurisdiction, and consent to our collection, use, disclosure and retention of your information as described in this Privacy Policy.
1.3. Your access to and use of the Services and the Interface are conditioned on Your acceptance of and compliance with this Privacy Policy.
1.5. If you are a resident of the European Union, supplementary terms at 13 relating to the GDPR apply. Please read these additional terms carefully as they supplement the Privacy Policy and form part of our agreement with you.
Interpretation
2.1. Account means a unique account created for you to access the Lizard DAO Activities made available through the Interface, including products or services.
2.2. Personal Information or Personal Data includes information and/or an opinion about an individual that is reasonably identifiable (i.e. name, age, gender, postcode, contact details, financial information, wallet address).
2.3. Services means access of the Lizard DAO Activities including but not limited to:
2.3.1. accessing the ethlizard.io website for the purpose of staking, claiming rewards and conducting Lizard DAO governance;
2.3.2. Battle in the Beyond website for the purpose of conducting Illuvium D1sk openings, Illuvium D1sk battles, wagering and claiming rewards; and
What personal information do we collect?
3.1. The categories of Personal Information the Lizard DAO may collect and process depends on the Lizard DAO Activities you engage in, but may include:
3.1.1. Personal details: name, gender, date of birth, nationality, tax residency;
3.1.2. Contact details: email address, address, mobile number, social media account information;
3.1.3. Interaction details: activity of your Account including products purchased and Services used;
3.1.4. Payment details: bank and credit card details, and in certain circumstances blockchain addresses.
3.1.5. Technical information: your device ID/IMEI, device type, geo-location, computer and connection information, page view statistics, traffic on our websites, ad data, IP addresses and web log information;
3.1.6. Blockchain transactions: bids, offers, buys, sells, transfers, fees, withdrawals, claims, mints, burns, or other like transactions associated with your IP address, your Ethereum public address or any other wallet address on any other blockchain;
3.1.7. Feedback information: information provided through different forms of feedback.
How do we collect Personal Information?
4.1. by you registering an Account via our Website or Interface;
4.2. make a purchase or place an order using our Interface;
4.3. communication with us through correspondence, chats, email, or when you share information with us from other social applications, Services or websites;
4.4. make enquiries, report suspicious market activity or submit comments, bug reports, ideas, or other feedback about the Interface and our Services;
4.5. connect your compatible Ethereum wallet to the Lizard DAO Interface, create an Immutable X wallet and connect the Immutable X wallet to the Lizard DAO Interface, sign a blockchain transaction or otherwise interact with the suite of smart contracts that comprise the Lizard DAO Activities from time to time;
4.6. interact with our Interface, Services, Lizard DAO Activities, content and advertising; or join a mailing list;
4.7. participate in a competition, promotion or survey; and
4.8. post a review, rating, comment, or other user-generated content on one of our websites or applications; and
4.9. invest in the Lizard DAO or enquire as to a potential investment or donation to support the Lizard DAO.
4.10. we may also collect Personal Information when we receive your Personal Information from third parties who legally provide it to us.
Why do we collect, use and disclose Personal Information?
5.1. We may use the information we collect for any of the following purposes:
5.1.1. enable you to access and use our Services and partake in Lizard DAO Activities;
5.1.2. to provide the Services and Lizard DAO Activities to you and to improve the aforementioned;
5.1.3. to operate, improve, and personalise the Services we offer, and to give each user a more consistent and personalised experience when interacting with us;
5.1.4. for customer service, security, to detect fraud or illegal activities, and for archival and backup purposes in connection with the provision of the Service;
5.1.5. to administer rewards, surveys, contests, or other promotional activities or events sponsored or managed by us or our business partners;
5.1.6. to ensure compliance with our legal obligations, including those set forth by gaming regulators;
5.1.7. to verify that you are at least 18 years old, or the required age of your local jurisdiction to engage in Lizard DAO Activities;
5.1.8. to verify that you reside in a jurisdiction in which we are providing the Service;
5.1.9. to fulfil your requests, including those related to wagering; and
5.1.10. to communicate with you.
Disclosure of Personal Information
6.1. Our employees and related bodies corporate of the Lizard DAO;
6.2. Professional advisers, dealers and agents;
6.3. Payment systems operators;
6.4. Our existing or potential agents, business partners or partners;
6.5. With Third Party Service Providers Performing Services on our behalf
6.5.1. We share your personal information with our service providers to perform the functions for which we engage them.
6.6. With Business Partners
6.6.1. We share Your personal information with businesses, who, pursuant to an agreement, hold our wagering licence for the jurisdiction you reside in, to comply with regulatory requirements.
6.7. For Legal Purposes
6.7.1. including government agencies, regulatory bodies and law enforcement agencies, or as required, authorised or permitted by law.
6.8. Changes of Control.
6.8.1. We may transfer or assign information, including Your personal information, in connection with a merger, acquisition, reorganisation, liquidation, change in control or other sale by or of us or any affiliated entity (in each case whether in whole or in part).
6.9. Our sponsors or promoters of any competition that we conduct via our Services and Lizard DAO Activities;
6.10. Lizard DAO does not share your personal information with third parties for those third parties’ direct marketing purposes.
Security
7.1. The Lizard DAO is responsible for designing Lizard DAO systems with your security and privacy in mind. The Lizard DAO will take reasonable steps to protect your Personal Information from misuse, interference, and loss, as well as unauthorised access, modification, or disclosure. Due to the emerging and uncertain nature of a DAO, Lizard DAO may appoint a Data Representative to own and control the data collected as a step to prevent unauthorised access to your Personal Information. The Lizard DAO Data Representative may use a combination of physical, administrative, personnel and technical measures (such as encryption protocols and software) to protect your Personal Information.
Your Rights
8.1. Right to access: you have the right to obtain confirmation that your Personal Information is processed and obtain a copy;
8.2. Right to rectify: you can request the rectification of Personal Information that is inaccurate or add to it;
8.3. Right to delete: you can, in some cases, have your Personal Information deleted;
8.4. Right to object: you can object, for reasons relating to your circumstances, to the processing of your Personal Information;
8.5. Right to limit the processing: in certain circumstances, you have the right to limit the processing of your Personal Information;
8.6. Right to portability: you can request to receive your Personal Information in a structured, commonly used, and machine-readable format, or, when this is possible, that we communicate your Personal Information on your behalf directly to another data controller;
8.7. Right to withdraw your consent: for processing requiring your consent, you have the right to withdraw your consent at any time; however, exercising this right does not affect the lawfulness of any processing based on your prior consent;
8.8. Right to set instructions relating to the use of your Personal Data post mortem: you have the right to define instructions relating to the retention, deletion, and communication of your Personal Information after your death;
8.9. Right to complain to the relevant data protection authority.
Data Retention
9.1. The Lizard DAO may hold your Personal Information for as long as it is reasonably necessary to enable you to access and use our Services and interact with Lizard DAO Activities. The Lizard DAO may retain your Personal Data wholly or partly for a longer or shorter period under applicable laws or any other lawful reason. The data retention periods may be altered from time to time based on regulatory or other changes.

10.1. What are cookies?
10.1.1. A cookie is a small file containing a string of characters that is sent to your computer when you visit a website or use an online service. When you visit the website or use the service again, the cookie allows that website or online service to recognize your browser or device. Cookies may store unique identifiers, user preferences and other information.
10.2. Duration of Cookies
10.2.1. We may use “session cookies” or “persistent cookies.” Session cookies are temporary and expire once you close your browser or once your session ends. Persistent cookies remain on your device for much longer or until you or your browser erase them. Persistent cookies have varying durations that are dependent on their expiration date.
10.3. Why do we use them?
10.3.1. Cookies help us improve the Service by providing us with information about which parts of the Service are most popular, enabling us to analyse technical and navigational information about the Service, and helping us to detect and prevent fraud. We also use cookies and other data collection tools (such as web beacons and server logs) to help improve your experience with the Service. For example, we use Google Analytics to help analyse how users use the Service. These tools use cookies to collect standard Internet log information and visitor behaviour information in an anonymous form. The information generated by the cookie about your use of the Service (including IP address) is transmitted to our data collection tool service providers. This information is then used by us to evaluate visitors’ use of the Service and to compile statistical reports on website activity for Lizard DAO. If you would like to opt-out from the use of your information by Google analytics, you may use Google’s analytics opt-out browser add-on designed for this purpose.
10.4. How do you control cookies?
Use of third-party websites and software
11.1. Our Service may contain links to third party websites. Any access to and use of such third-party websites is not governed by this Privacy Policy but is instead governed by the privacy policies of those third-party websites, and we are not responsible for the information practices of such third-party websites.
11.2. All token transactions made through the Interface are facilitated and run through your compatible Ethereum wallet (e.g. MetaMask, a Third-party Extension).
11.3. Certain NFTs (such as Illuvium D1sks) are transferred and minted using the Immutable X platform (Third-party Platform). The Lizard DAO Interface enables access to an Ethereum-based suite of applications (e.g. staking, rewards, vesting, claiming, exchange, auctions) allowing users to interact with the smart contracts deployed to the Ethereum blockchain to assist with facilitating token activities.
11.4. By using a Third-party Extension, a Third-party Platform, or any other Third-party services to access our Services you agree that you are governed by the terms of service and privacy policy for the applicable Third-party Extension, applicable terms for the Third-party Platform, or the terms and privacy policy of any other Third-party services.
11.6. You acknowledge and agree that the Lizard DAO shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such third-party content, goods or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
Making a complaint
12.1. If you have concerns about how we or the Lizard DAO has handled your Personal Information, you can contact the Lizard DAO using the details below. Please include your name, email address and clearly describe your complaint. The Lizard DAO will acknowledge your complaint and respond to you within a reasonable period. If you think the Lizard DAO has failed to resolve the complaint satisfactorily we will provide you with information about further steps you can take. You also have the right to contact your local data protection authority.
Supplementary Terms - GDPR
13.1. Personal Data for the purposes of the GDPR means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity.
13.2. The Lizard DAO generally collects your Personal Data directly from where you are based and may store it on servers outside the EU or the European Economic Area (EEA) in countries such as Australia or the USA, where data protection standards may be lower than in the EU/EEA.
13.3. If you are within the EU you have the right under the GDPR to:
13.3.1. Access, correct, update or erase the information we have on you.
13.3.2. Object to processing of your Personal Data: This right exists where we are relying on a legitimate interest as the legal basis for our processing and there is something about your particular situation that makes you want to object to our processing of your Personal Data.
13.3.3. Request the transfer of Your Personal Data: We will provide to you, or to a third-party you have chosen, your Personal Data in a structured, commonly used, machine-readable format. Please note that this right only applies to automated information which you initially provided consent for us to use or where We used the information to perform a contract with you.
13.3.4. Withdraw Your consent: You have the right to withdraw Your consent on using your Personal Data. If You withdraw Your consent, We may not be able to provide You with access to certain specific functionalities of the Service.
13.4. Exercising Your GDPR Data Protection Rights:
13.4.1. You may exercise Your rights of access, rectification, cancellation and opposition by contacting us by using the information above. From time to time, the Lizard DAO may not be able to provide you with access to all of your Personal Information and, where this is the case, we will tell you why. We may also need to verify your identity when you request your Personal Information. If you think that any Personal Data we hold about you is inaccurate, please contact the Lizard DAO and we will take reasonable steps to ensure that it is corrected. You have the right to complain to a Data Protection Authority about our collection and use of your Personal Data.
